RETAINER PAYMENT & SESSION AGREEMENT
This payment secures your RETAINER FEE for Family, Engagement, Maternity, Children, Senior, or Newborn Sessions. (Excludes Weddings.)
PLEASE READ CAREFULLY BEFORE SUBMITTING YOUR RETAINER.
By submitting your retainer, you (“Client”) acknowledge that you have read, understand, and agree to the terms below, forming an agreement with Cheryl Moore Photography & Design (“Photographer”).
Retainer Fee & Payment
The retainer reserves your session date and time, is applied toward your session balance, and covers pre-session consultation, communication, planning, and preparation. Once received, your session is placed on the Photographer’s calendar and other inquiries for that time may be declined.
The retainer is non-refundable if the Client cancels. At the Photographer’s discretion, it may be transferred to a rescheduled session due to illness, weather, emergency, or other approved circumstances.
The remaining balance is due at the conclusion of the session and should be paid by cash or check. Returned checks are subject to a $50 service fee.
Editing Style & Client Preferences
By booking, the Client acknowledges reviewing and accepting the Photographer’s photographic and editing style. Final images are professionally selected and edited at the Photographer’s artistic discretion, including adjustments to color, exposure, skin tones, cropping, blemishes, distractions, and other enhancements.
If the Client prefers a more natural or minimal editing style, this MUST be communicated before or during the session.
Requests to substantially change the editing style after gallery delivery are not considered editing corrections and may be declined or subject to an additional editing fee.
Image Selection, RAW & Unedited Files
The Photographer determines which images are included in the final gallery. Duplicates, test shots, missed focus, closed eyes, undesirable expressions, or images that do not meet professional standards may be excluded. Not every image photographed will be delivered.
Cheryl Moore Photography & Design does not provide RAW or unedited files. RAW, unedited, or unfinished images are not included with any session or package and will not be released.
Copyright, Editing & Artificial Intelligence
All images remain the copyrighted property of Cheryl Moore Photography & Design. Clients receive personal-use rights to final digital images included with their package.
Delivered images may not be sold, substantially altered, re-edited, filtered, or used to create derivative images without written permission.
Images may not be uploaded or submitted by the Client to artificial intelligence (AI) services to generate new images, substantially alter the Photographer’s work or editing style, create derivative images, or train AI models without written permission.
The Photographer may use professional editing software, including software containing AI-assisted features, as part of the normal retouching and creative process.
Image Sharing & Social Media
Cheryl Moore Photography & Design may request the Client’s permission to share selected images on the Photographer’s website, portfolio, social media, advertising, or other promotional materials.
Session Time & Tardiness
Sessions begin at the scheduled time, regardless of tardiness or lack of preparation. Additional time may be purchased in 15-minute increments at $25, subject to availability.
The Photographer is not responsible for time lost due to forgotten items, uncooperative subjects, outfit changes, or other circumstances outside the Photographer’s control. Travel between locations and outfit changes count toward session time.
Clients arriving more than 15 minutes late without communication may have their session rescheduled or canceled without refund of the retainer.
Additional Participants & Locations
Additional individuals not included in the original booking may be subject to a $25 fee per person.
Clients requesting specific locations are responsible for applicable access, permit, admission, or parking fees and obtaining required permissions or permits.
Client Conduct & Session Conditions
The Photographer is not responsible for missed or limited images due to participants who are uncooperative, unwilling to participate, or fail to appear.
No other cameras, including cell-phone photography or video, may be used during the session without Photographer permission.
The Photographer may adjust the session time or location when necessary due to lighting, weather, safety, or other conditions affecting the session.
Rescheduling & Weather
Outdoor sessions may be rescheduled due to weather or unsuitable conditions at the Photographer’s discretion.
If the Photographer cannot perform the session due to illness, emergency, or unforeseen circumstances, reasonable efforts will be made to reschedule. If rescheduling is not possible, the retainer may be refunded.
Health & Safety
The studio and appropriate props, surfaces, and equipment are regularly cleaned and disinfected.
If anyone being photographed has experienced fever, cough, significant fatigue, contagious illness, or other symptoms of illness within 48 hours of the session, please contact the Photographer to discuss rescheduling. Illness-related rescheduling will be handled with reasonable flexibility.
Digital Images & Printing
Digital images included with the Client’s package are professionally edited and provided for personal use.
The Photographer cannot guarantee color, cropping, or print quality from outside labs, screenshots, social-media downloads, or other reduced-quality sources. For the best quality, Clients are encouraged to order prints directly through their online gallery.
Final Agreement
By submitting the retainer payment, the Client confirms that they have read, understand, and agree to this Retainer Payment & Session Agreement.
